Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling charges, he was detained in federal custody.

In her order, the court pointed out that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal proceedings center on conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.
